By purchasing and downloading digital video content ("the Product") from DC Collective® ("the Company," "we," "us," or "our"), you ("the Customer," "user," or "you") acknowledge and agree to the following terms governing your download and use of the Product.
1. Download Limitations & Access
Each purchase grants the Customer a limited license to download the digital Product. This license is personal, non-transferable, and non-exclusive.
- Download Attempts: Your purchase includes a maximum of three (3) successful download attempts per unique download link provided. It is the Customer's responsibility to ensure the download is completed successfully and saved to their intended device within these attempts.
- Link Expiration: Download links are active for a limited time (e.g., 30 days from purchase). The Company is not responsible for providing new links if the original link expires or if all download attempts are exhausted.
2. User Responsibility & Technical Requirements
The Customer assumes full and sole responsibility for the successful download, storage, and use of the Product.
- Technical Compatibility: It is the Customer's responsibility to ensure their computer, mobile device, software, and internet connection meet any necessary technical requirements for downloading and viewing the Product. The Company is not liable for any technical limitations, failures, or errors on the part of the user's equipment, software, or internet service provider.
- Data Usage: The Customer is responsible for any data charges incurred from their internet service provider while downloading the Product.
3. Recommended Best Practices
To ensure a successful experience and to conserve your download attempts, we strongly recommend the following:
- Primary Download: Initiate and complete your first download on a stable home or office computer with a reliable internet connection.
- Secure Storage: Immediately save the downloaded video file(s) to a secure, permanent location on your computer (e.g., hard drive, external storage device, or cloud service you manage).
- File Transfer: After the file is securely saved on your primary computer, you may transfer a copy to your mobile devices for viewing. This practice prevents the need to download the file directly to a mobile device, which can be more prone to user error and may inadvertently use your limited attempts.
4. Intellectual Property & Copyright
The Product and all content contained within, including but not limited to video, audio, graphics, text, and trademarks, is the exclusive intellectual property of DC Collective® and is protected by United States and international copyright and trademark laws.
- Limited License: Your purchase grants you a limited, non-exclusive, non-transferable license to view the Product for your personal, non-commercial use only.
- No Transfer of Ownership: You do not acquire any ownership rights or intellectual property interest in the Product. DC Collective® remains the sole and exclusive owner of all rights, title, and interest in the Product.
- Strictly Prohibited: You are expressly prohibited from:
- Reproducing, duplicating, copying, selling, reselling, or exploiting any portion of the Product for any commercial purpose whatsoever.
- Distributing, publicly performing, broadcasting, or sharing the Product with any third party.
- Modifying, creating derivative works from, or reverse-engineering the Product.
- Removing any copyright, trademark, or other proprietary notations.
- Any unauthorized use of the Product is a violation of these terms and may violate copyright, trademark, and other laws. DC Collective® will enforce its intellectual property rights to the fullest extent of the law.
5. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE HELD LIABLE FOR ANY LOSS OF DATA, LOST DOWNLOAD ATTEMPTS, OR INABILITY TO ACCESS THE PRODUCT ARISING FROM:
- USER ERROR, INCLUDING BUT NOT LIMITED TO, FAILURE TO FOLLOW RECOMMENDED DOWNLOAD PROCEDURES.
- FAILURE TO SAVE THE PRODUCT TO A SECURE LOCATION AFTER DOWNLOAD.
- TECHNICAL ISSUES RELATED TO THE USER'S HARDWARE, SOFTWARE, NETWORK, OR MOBILE DEVICE CONFIGURATION.
- INADVERTENT CONSUMPTION OF DOWNLOAD ATTEMPTS DUE TO MOBILE DOWNLOAD COMPLICATIONS, BROWSER ISSUES, OR NETWORK INTERRUPTIONS.
The Company's sole liability and the Customer's exclusive remedy in the event of a verified fault on the Company's side (e.g., a broken download link provided by us) shall be limited to the replacement of the download link or a refund of the purchase price, at the Company's sole discretion.
6. No Warranty
The Product is provided on an "AS IS" basis. The Company disclaims all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose, to the fullest extent permissible by law.
By completing your purchase and initiating the download, you signify your understanding and acceptance of these terms.
